Terms & Conditions

These terms govern your use of the Pulau Strategy website and the advisory services we provide. Please read them carefully before proceeding.

1. Definitions

Throughout these Terms, the following words have the meanings described:

  • "Agreement" — these Terms and Conditions together with any engagement letter or proposal accepted by you.
  • "Service" — business advisory and consulting services offered by Pulau Strategy, including Cross-Border Trade Advisory, Inter-Island Operations Review, and Coastal Industry Consultation.
  • "User" / "You" — any individual or business entity accessing our website or engaging our services.
  • "We" / "Us" / "Our" — Pulau Strategy, operating from Level 22, Menara Standard Chartered, Jalan Sultan Ismail, 50250 Kuala Lumpur.
  • "Content" — all text, reports, findings, recommendations, and materials produced as part of a service engagement.
  • "Engagement" — a confirmed advisory project agreed between Pulau Strategy and the client.

2. Acceptance of Terms

By accessing this website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you should not use this website or proceed with an engagement.

You confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Where you act on behalf of a business entity, you confirm you have authority to bind that entity.

3. Service Description

Pulau Strategy provides business advisory services to established Malaysian businesses seeking considered external perspective on trade, operations, and coastal industry matters. Our services include:

  • Cross-Border Trade Advisory (MYR 2,890) — eight-week engagement covering regulatory mapping, ASEAN partner identification frameworks, and risk consideration.
  • Inter-Island Operations Review (MYR 3,180) — ten to fourteen-week engagement for businesses with Peninsular, Sabah, and Sarawak operations.
  • Coastal Industry Consultation (MYR 425) — six to nine-week engagement for fisheries, aquaculture, marine services, and coastal tourism operators.

Service availability is subject to advisor capacity. We operate primarily within Malaysia but may advise on regional ASEAN matters where within our scope of expertise.

4. User Responsibilities

When using our website or engaging our services, you agree to:

  • Provide accurate and complete information during the enquiry and engagement process.
  • Use any materials or outputs from engagements solely for your own legitimate business purposes.
  • Not reproduce, share, or distribute our proprietary content without prior written consent.
  • Maintain the confidentiality of any pricing, methodology, or advisor materials shared with you.
  • Refrain from any conduct that could damage the reputation or operations of Pulau Strategy.
  • Comply with all applicable Malaysian laws in your use of our services.

5. Intellectual Property

All content on this website — including text, design elements, service frameworks, and methodologies — is the intellectual property of Pulau Strategy unless otherwise stated.

Upon completion of a paid engagement, you receive a non-exclusive, non-transferable licence to use the deliverable reports and findings for your internal business purposes. This licence does not extend to methodology documentation, frameworks, or tools used in producing those deliverables.

You may not reproduce, adapt, or distribute any of our proprietary materials without prior written consent.

6. Payment Terms

All fees are quoted and payable in Malaysian Ringgit (MYR). Payment terms for each engagement are outlined in the engagement letter. Standard terms include:

  • A deposit of 50% of the engagement fee payable upon confirmation.
  • The remaining balance payable upon delivery of final written findings.
  • Payment by bank transfer to Pulau Strategy's nominated account.

Cancellation: If you cancel an engagement after the deposit has been received, the deposit is non-refundable where preparatory work has commenced. Cancellations before work commencement will be handled on a case-by-case basis. We will communicate clearly and fairly in any such situation.

All fees are subject to applicable Malaysian taxes where required by law.

7. Engagement-Specific Terms

Each advisory engagement is scoped through a written engagement letter setting out objectives, deliverables, timelines, and responsibilities. Changes to scope during an engagement will be discussed and agreed in writing before additional work proceeds.

Timelines are indicative and may be affected by the availability of information from your organisation, site access requirements, or other factors outside our direct control. We will keep you informed of any material changes.

All written findings and recommendations are confidential to you. We will not disclose client-specific information to third parties without your consent, except where required by law.

8. Disclaimers

Our advisory services are provided in good faith based on information available at the time and the expertise of our advisors. However, we make no representation that our findings will produce any particular business outcome.

Advisory recommendations are for your consideration. Business decisions and their consequences remain your responsibility. Our observations do not constitute legal, financial, or regulatory advice unless explicitly stated in the engagement letter.

Website content is provided for general informational purposes. We do not warrant that information on this site is current, complete, or free from inaccuracy at all times.

9. Limitation of Liability

To the fullest extent permitted under Malaysian law, Pulau Strategy's total liability arising from any engagement shall not exceed the total fees paid by you for that specific engagement.

We shall not be liable for indirect, consequential, incidental, or special loss or damage — including loss of revenue, business opportunity, or goodwill — arising from your use of our services or website, even if we have been advised of the possibility of such loss.

Nothing in these Terms limits liability for fraud, wilful misconduct, or any matter that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold Pulau Strategy, its advisors, and associates harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of our services, or your violation of any applicable law.

11. Termination

Either party may terminate an engagement by providing written notice. Terms covering payment for work completed, confidentiality, intellectual property, and limitation of liability survive any termination.

We reserve the right to decline or discontinue services where, in our reasonable assessment, the engagement falls outside our area of competence or creates a conflict of interest.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or relating to these Terms or an engagement shall first be referred to informal negotiation between the parties.

If a dispute cannot be resolved informally within 30 days, it shall be submitted to the jurisdiction of the courts of Malaysia, with Kuala Lumpur as the preferred venue.

Mediation through the Malaysian Mediation Centre may be agreed as an alternative before formal proceedings.

13. General Provisions

  • Entire Agreement: These Terms, together with any engagement letter, constitute the entire agreement between us.
  • Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights with notice to you.
  • Notices: Formal notices under these Terms should be sent in writing to the address below or by email to [email protected].

14. Changes to Terms

We may update these Terms from time to time. Material changes will be indicated by a revised "Last Updated" date on this page. Your continued use of our website following any revision constitutes acceptance of the updated Terms. For active engagements, existing terms remain in effect unless both parties agree in writing to revised terms.
